Consumer Rights – Withdrawal – Cancellation Refund Conditions
GENERAL:
1. When you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.
2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (OG:27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.
3. Shipping costs related to the product shipment will be paid by the buyers.
4. Each purchased product shall be delivered to the person and/or organization at the address specified by the buyer, provided that it does not exceed the statutory period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.
5. The purchased product must be delivered intact and in accordance with the specifications indicated in the order, along with warranty certificates, user manuals, or other documents, if any.
6. If it becomes impossible to sell the purchased product, the seller is obliged to notify the buyer in writing within 3 days of becoming aware of this situation. The total amount must also be refunded to the buyer within 14 days.
IF THE PURCHASED PRODUCT PRICE IS NOT PAID:
7. If the buyer does not pay the product price or cancels it in bank records, the seller's obligation to deliver the product ceases.
UNAUTHORIZED USE OF CREDIT CARD PURCHASES:
8. If after delivery, it is determined that the credit card used by the buyer for payment was unfairly used by unauthorized persons and the sold product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the contract subject product to the seller within 3 days with shipping costs borne by the SELLER.
IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:
9. If the seller encounters force majeure circumstances beyond their control and the product cannot be delivered on time, the buyer is notified. The buyer may request the cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the buyer cancels the order; if payment was made in cash, the amount will be refunded within 14 days. If the payment was made by credit card and the order is canceled, the product price is refunded to the bank within 14 days, although the bank may take 2-3 weeks to credit the buyer’s account.
BUYER'S OBLIGATION TO INSPECT THE PRODUCT:
10. The buyer must inspect the goods/services before taking delivery; damaged and defective goods/services such as dented, broken, torn packaging, etc., must not be accepted from the shipping company. The accepted goods/services are deemed undamaged and intact. After delivery, the BUYER must carefully preserve the goods/services. If the right of withdrawal will be used, the goods/services must not be used. The product must also be returned with the invoice.
RIGHT OF WITHDRAWAL:
11. The BUYER may exercise the right of withdrawal without any legal or criminal liability and without stating any reason by notifying the SELLER within 14 (fourteen) days from the delivery date of the product to the buyer or the person/organization at the designated address via the following contact details.

DURATION OF THE RIGHT OF WITHDRAWAL:
13. If the purchased product is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be used for contracts where the buyer agrees to start performance of the service before the withdrawal period ends. The withdrawal right notice is provided in the Distance Contracts and Cancellation Terms sections, and the buyer places the order knowing these conditions.
14. Costs arising from the exercise of the withdrawal right belong to the SELLER.
15. To exercise the right of withdrawal, within 14 (fourteen) days, the buyer must notify the SELLER in writing by registered mail with return receipt, fax, email, or by other methods specified by the SELLER, and the product must be unused in accordance with the "Products Not Subject to Right of Withdrawal" provisions of this agreement.
EXERCISE OF RIGHT OF WITHDRAWAL:
16. The invoice of the product delivered to the third party or the BUYER (if the returned product’s invoice is corporate, it must be sent back with the return invoice issued by the company. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is issued.)
17. The return form, the product’s box, packaging, and any standard accessories must be delivered complete and undamaged.
RETURN CONDITIONS:
18. The SELLER is obliged to refund the total amount and return the documents binding the BUYER within a maximum of 10 days from receipt of the withdrawal notice, and to receive the goods within 20 days.
19. If the value of the goods decreases or the return becomes impossible due to the BUYER’s fault, the BUYER is liable to compensate the SELLER for damages to the extent of the fault. However, the buyer is not responsible for changes or deteriorations arising from proper use of the goods within the right of withdrawal period.
20. If the use of the right of withdrawal causes the campaign limit amount determined by the SELLER to be reduced, the discount received under the campaign will be canceled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:
21. Products prepared upon the buyer’s request or personal needs that cannot be returned, underwear bottom parts, swimwear bottoms, makeup products, disposable goods, perishable or with possible expiry dates, products unsuitable for return due to opened packaging for health and hygiene reasons after delivery, products mixed with others after delivery and cannot be separated by nature, goods related to periodicals such as newspapers and magazines except for subscription agreements, services performed instantly in electronic form or intangible goods delivered instantly to the consumer, audio or video recordings, books, digital content, software programs, data recording and storage devices, computer consumables, products whose packaging has been opened by the buyer cannot be returned according to the Regulation. Also, right of withdrawal cannot be used for services started with consumer approval before the withdrawal period ends as per the Regulation.
22. Cosmetic and personal care products, underwear, swimwear, books, copyable software and programs, DVDs, VCDs, CDs, cassettes and stationery consumables (toner, cartridge, ribbon, etc.) must have unopened, unused, unopened packaging to be eligible for return.
23. According to the Distance Contracts Regulation, products for which the right of withdrawal cannot be used include:

Contracts for goods prepared according to the consumer’s requests or personal needs.

Contracts for goods that are perishable or likely to expire.

Contracts for goods where protective elements such as packaging, tape, seals, packs have been opened after delivery, and which are unsuitable for return for health and hygiene reasons.

Contracts for goods mixed with other products after delivery and which are naturally impossible to separate.

Contracts related to books, digital content, and computer consumables provided in material form where protective elements such as packaging, tape, seals, packs are opened after delivery.

Contracts related to accommodation, transportation of goods, car rental, food and beverage supply, and leisure activities to be performed on a specific date or period.

Contracts for services performed immediately in electronic form or intangible goods delivered instantly to the consumer.
DEFAULT AND LEGAL CONSEQUENCES
24. If the buyer makes payments by credit card and falls into default, the buyer accepts, declares, and undertakes that they will pay interest and be liable to the bank under the credit card agreement with the card issuer bank. The bank may take legal action, claim costs and attorney fees from the buyer. In any case, if the buyer is delayed in payment due to default, the buyer agrees to compensate the seller for all damages caused by the delay.
